DMCA Policy

ImmersiVerse OS respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using the Platform. This policy outlines how to submit a DMCA takedown notice, file a counter-notice, and our approach to repeat infringers.
1. Filing a DMCA Takedown Notice
If you believe that content on ImmersiVerse OS infringes your copyright, you may submit a written notification to our designated DMCA Agent. Your notice must include the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., a URL)
- Your contact information, including your name, address, telephone number, and email address
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the owner
2. Counter-Notice
If you believe that your content was removed by mistake or misidentification, you may submit a counter-notice. Your counter-notice must include:
- Your physical or electronic signature
- Identification of the material that was removed and the location where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if outside the United States, any judicial district in which ImmersiVerse OS may be found
- A statement that you will accept service of process from the person who provided the original DMCA notice or an agent of such person
Upon receipt of a valid counter-notice, we will forward it to the original complaining party. If the original party does not file a court action within 10 business days, we may restore the removed content.
3. Repeat Infringers
ImmersiVerse OS maintains a policy of terminating, in appropriate circumstances, accounts of users who are deemed to be repeat infringers. If a user has been the subject of three or more valid DMCA takedown notices, their account may be permanently suspended without prior warning. We reserve the right to terminate any account at our sole discretion if we believe the user is engaging in a pattern of copyright infringement.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages.
5. Modifications
We reserve the right to modify this DMCA Policy at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Platform after changes are posted constitutes acceptance of the updated policy.
